Modality's Customer Privacy Policy covers the collection, use and disclosure of personal information that may be collected by Modality, Inc. ("we" or "our") anytime you interact with us, such as visiting our website (this "Site"), when you purchase our products ("applications"), or when you call our sales and support associates.  This Privacy Policy describes the types of personal information Modality collects and how we use, share and protect that information. 
This Privacy Statement does not govern our collection of information through a website or other means, other than through this Site and through our products.

What information do we collect and how is it used?

Personal Information.  When you register with Modality, Inc., you will be asked to provide certain Personal Information, such as your name, e-mail address and other information.  We may also request additional optional information during registration to assess the scope of our customers' needs and to tailor our applications to you, to provide personalized services and to communicate separately with you via email or postal mail.  Once you provide us with your Personal Information, you are not anonymous to us.
We may ask for your personal information when you're discussing a service issue on the phone with an associate, downloading an update, registering for an event, or participating in a survey.
We use Personal Information collected for the purposes of:

Aggregate Information.  When you visit this Site we examine your browser type to ensure compatibility between our applications and the various Web browsers used to access this Site.  We also collect Aggregate Information automatically from "cookies" about your visit to this Site.

Your Modality ID
The Modality website, as well as our products, allows you to create a "Modality ID" based on your personal information. Here's how it works: You create a personal profile — providing your name, email address, iPhone or iPod UDID and in some cases your mailing address and phone number— and choose a password and password hint (such as the month and day of your birth) for security. The system saves your information and assigns you a personal Modality ID — in many cases simply your email address, because it's unique and easy to remember. The next time you interact with Modality or register a new product, all you need to do is enter your Modality ID and password; the system looks up the information it needs to assist you.

Do I get to choose what information I disclose?
Yes, you can always choose whether or not to provide information on this Site or through registration when purchasing a Modality product.  However, if you choose not to disclose certain information, such as your name, e-mail address and preferred user ID, you may not be able to register and your access to certain portions of this Site or enhanced customer service may be limited.

Information We Share
We take your privacy very seriously and do not sell, rent, trade or otherwise disclose Personal Information about visitors to this Site or who purchase our products, except as described herein.  We may share information provided by visitors with:

Modality takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction.
This Site is operated from a secure environment with integrated security measures to help protect against the loss, misuse and alteration of Personal Information provided on this Site.  We use Secure Socket Layer (SSL) technology for this Site to provide security during transmissions of Personal Information.  No method of transmitting or storing data is completely secure.  As a result, although we strive to protect your Personal Information, we cannot guarantee the security of any information you transmit to us through or in connection with this Site.  If you have reason to believe that your Personal Information is no longer secure, please notify us immediately by contacting us in accordance with the last section below.

A Special Note about Children
Children are not eligible to use our services without the permission of a parent or guardian, and we ask that minors (under the age of 13) not submit any Personal Information to us.  If you are a minor, you can use this service only in conjunction with your parents or guardians.

What if I need to change the Personal Information I previously disclosed?
You may change your Personal Information at any time.  We encourage registered users to keep their Modality ID current.  You can update your Personal Information by selecting the ‘My Account Information' option on the ‘My Modality' page, then select ‘Edit Your Modality ID'.  Changes to your Personal Information may be made only through this Site.

Updates to this Privacy Statement
We may change or update this Site, our Applications, or any of our policies and procedures without prior notice.  We will post a notice on this Site to advise you of any significant changes to this Privacy Statement and indicate at the top of this statement when it was most recently updated.
